Terms & Conditions

By making a booking at Ben Nevis Station you agree to these Terms and Conditions.
Please read these Terms and Conditions carefully.


1 DEFINITIONS
1.1 Peak Season – the following periods in each calendar year:
• 20 December – 05 January
• Easter (Good Friday, Easter Saturday, Easter Sunday and Easter Monday)
• All other statutory holidays observed in New Zealand
• Otago Anniversary Day
1.2 The Property – any property located at Ben Nevis Station.
1.3 Us, we, our – Nevis Valley Station Limited and its agents.
1.4 You – all future, current or past guests of Ben Nevis Station and agents booking on behalf of
guests.


2 RATES & INCLUSIONS
2.1 Rates include 15% GST (if any).
2.2 Rates are quoted in New Zealand dollars ($NZD).
2.3 Rates are charged on a per night basis.
2.4 Rates are subject to confirmation at the time of reservation and subject to all payments being paid by due dates.
2.5 Child policy:
• Children under the age of 16 years are not permitted.
• Children aged 16 years or older are considered full rate paying guests. 
2.6 Check-in is at 2pm and check-out is at 11am.
2.7 Inclusions: the following are included in each guest stay.
•All meals prepared by in-house Ben Nevis Station chef (breakfast, lunch, dinner, morning and afternoon teas, refreshments and picnics)
•Ben Nevis Station staff
•Premium wine and beverages.
•WiFi
•Signature Half Day Adventure Buggy Guided Self Drive Tour and Signature Clay Target Shooting and Archery
•Use of lodge facilities including, spa pool, push bikes.


3 RESERVATION & CANCELLATION POLICY 
3.1 Minimum night stay:
3.1.1 A minimum 2-night stay applies to all bookings, subject to clause 3.1.2.
3.1.2 Between 20 December – 05 January, a minimum 3-night stay applies.
3.2 Booking confirmation: to secure a booking at Ben Nevis Station you must agree to terms and conditions outlined in this Accommodation Agreement, together with a 25% deposit. 
3.3 Final payment: final payment is required 45 days prior to the reservation check-in date, except for bookings made for stays during the Peak Season where full payment is required 60 days prior to the reservation check-in date. A credit card fee may be added for any payment received via credit card. Any outstanding credit card fees may be invoiced with the final balance invoice.
3.4 Cancellation:
3.4.1 The following applies to the cancellation of all bookings, except during the Peak Season:
• If a reservation is cancelled 30 or less days prior to the reservation check-in date, 100% of the total cost will be charged for every night cancelled including pre-booked activities;
• If a reservation is cancelled between the date of booking confirmation and 31 days prior to the reservation check-in date, the 25% non-refundable deposit shall be retained by us.
3.4.2 The following applies to the cancellation of all bookings during Peak Season:
• If a reservation is cancelled 60 or less days prior to the reservation check-in date, 100% of the total cost will be charged for every night cancelled including pre-booked activities;
• If a reservation is cancelled between the date of booking confirmation and 61 or more days prior to the reservation check-in date, the 25% non-refundable deposit shall be retained by us.

 


4 CANCELLATION BY US
4.1 If you do not pay the deposit or the requested amounts by the dates that they are due, and or agree to the  terms and conditions outlined in this Accommodation Agreement, your reservation will not be confirmed and we will be entitled to terminate the tentative booking.


5 BOND
5.1 Guests are required to provide their credit card details upon arrival and a pre-authorisation of the rate of one night’s accommodation rate will be taken as security on check-in at Ben Nevis Station.
5.2 You agree that we are entitled to debit the credit card referred to in clause 5.1 or that you provided in this Accommodation Agreement for any amount which is payable by you under these Terms and Conditions including to cover any costs incurred such as the repair of any damage to the Property, missing items belonging to the Property, excessive cleaning, rubbish removal and additional staff hours incurred as a result of your stay.


6 ON-SITE ACTIVITIES
6.1 You agree that any services or activities to be used or undertaken on the Property (including helicopter transfers landing on the Property) are to be booked and managed by Ben Nevis Station staff. In some circumstances, we can permit helicopter landings on the Property that are not booked through Ben Nevis Station staff, however this is subject to our written authorisation and a landing fee applies.
6.2 Events on the Property or use of the Property as a venue require our express authorisation in writing and may be an additional cost.
6.3 Public access to Ben Nevis Station is prohibited at all times and our permission is required guests / visitors to access the Property.


7  CHILDREN & FAMILIES
7.1 Please see clause 2.5 regarding bedding arrangements.


WORKING FARM 
8.1You acknowledge that the Property is a working farm and farming practices are undertaken on the Property. You acknowledge to illustrate care towards the animals, plants, land and structures and not to leave any rubbish or food anywhere on the Property.
8.2 In consideration of clause 8.1, you also agree that the Property beyond the vicinity of the Homestead & Cottages must only be accessed while accompanied by a Ben Nevis Station guide.


9 YOUR RESPONSIBILITIES
9.1 You may not accommodate more than the maximum number of occupants as stated in the Accommodation Agreement, nor may you accommodate anyone not named on the guest check-in declaration that guests are to complete on arrival at Ben Nevis Station.
9.2 You are responsible for the cost of repairing any damaged or missing furniture, fixtures and fittings on the Property.
9.3 You must take reasonable care of your own health and safety and must make sure that you behave in a safe manner at all times. You agree to observe any health and safety policies and procedures put in place by us at all times, and must ensure that your acts or omissions do not endanger the health and safety of any other person.


10 DEPARTURE
10.1 You shall vacate the property no later than the required departure time as notified to you by us.
10.2 Late check-out is subject to availability at a cost equivalent to 50% of one night’s accommodation rate.
10.3 Accounts must be settled in full prior to departure.


11 INSURANCE/LIABILITY
11.1 Your personal effects are not insured by us. You are responsible for all personal items you bring to the Property and for any loss or damage to such items.
11.2 All facilities and any activities you participate in will be at your own risk. We do not accept any responsibility for injury or loss suffered. You will be required to sign a digital registration and risk disclosure form upon arrival.
11.3 Children must be supervised at all times by a parent or responsible adult.
11.4 We do not and will not make any representations or give any express or implied warranties
of any kind in relation to the Property.
11.5 All dietary requirements must be notified in writing. While all reasonable endeavours will be taken to ensure such dietary requirements are met, we cannot guarantee that no traces or contamination that is beyond our control will not occur.


12 DISPUTES
12.1 If a dispute arises between you and us, we will use our reasonable endeavours to obtain resolution of the dispute by discussion between all concerned parties. If that process does not result in resolution of the dispute, then the dispute may be referred by any of the parties to the New Zealand Disputes Tribunal. A dispute does not excuse any party from performing its obligations under these Terms and Conditions.


13 GENERAL
13.1 All parties agree that the laws and courts of New Zealand have exclusive jurisdiction to the arrangements between the parties and to any matter referred to in this document.


14 FORCE MAJEURE
14.1 No party will be liable for any delay or failure to perform its obligations under these Terms and Conditions if that delay or failure is caused by any event beyond its reasonable control, provided that party promptly gives written notice of fact and circumstances of that event to the other party and uses all reasonable endeavours to mitigate its effects.
